It's up to what a judge or jury might determine. I suspect it's pretty rare.
But I have come to believe - even though I don't like it - that anyone can be held "culpable" for anything that those with enough power want them to be culpable for. Whether it's the confining of Galileo for stating that the earth goes around the sun or the banning of Joe Faust for saying that hang gliding ratings should be objective.
The institutions of man are always capable of injustice in the hands of the corrupt. That's why it's a never-ending struggle to ensure that the institutions of man are in the hands of the best people we can find.
