Warren and Partners,
Due to recent threats to AAS concerning alligations that AAS is
operating
illegally, I scheduled and attended a meeting in Wichita KS with 5
officials
from the FAA. The Wichita office has jurisdiction over our operations
at
Ottawa Municipal Airport. I will be writing a more in-depth explanation
later. If you want details you can call me.
At the time of this email I'm waiting for a response from Sue Gardner
and
Kathy Person as to how we may proceed.
During the meeting I covered all the procedures and aspects of our
operation
and how it is essentially the same as 98% of the tow parks across the
US.
The FAA is well aware of our industry, but still in the dark as to the
specific types of equipment, aircraft and procedures being utilized. We
talked specifically about my reasons for asking for the FAA's
assistance as
well as who has flown the DF, in what manner, had there been any
accidents
or incidents and whether those pilots held current FAA issued Private
Pilots
Licenses. Sue Gardner was contacted by phone during our meeting and
asked
that I stay in the office for a while in order to give me a response.
As she
was unable to reach Jayne at the USHGA office, I eventually left
without
official word. The FAA officials were very impressed that I/We chose to
come
forward. One officer stated that it spoke volumes for our organization.
Just before I left Kathy Person came into the office were I was
speaking to
the FAA's Safety Manager to make one point clear to me. She stated, "If
Mr.
Narron were to call this office and force the FAA to take action on
this
issue, he will also be included and implicated in any ruling, sanction
or
fine."
The only way any pilot of the DF would have been in the clear, is if
they
had been a card carrying Instructor with the ASC, operating under EX
6080e.
ASC is the only organization the had been granted a weight exemption
for 2
place UL's and for instructional purposes only. My records show that no
one
flying the DF is in this category. I wonder if Les is an ASC member.
My gut feeling is that by having the meeting I/We have forced the FAA's
hand
in dealing with this issue. They will have to somehow come up with a
solution that will allow the flight parks across the US to continue
without
shutting down operations. My gut tells me that they will have to issue
some
kind of emergency or temporary exemption. There is a possibility the
USHGA
will have to apply for a modified 6080e that will encompass 4144, thus
giving our privileges on a legitimate basis until the SP ruling is
final.
This is serious s*** guys. I just spoke to the FAA office and Sue has
asked
for my phone number. The person that I spoke to said it is likely that
a
temporary solution will be found in order to keep the US flight parks
open,
but it may run into the next week. Jayne is in Costa Rica next week,
but she
is reachable on an emergency basis. Hold on tight...
