OK, let me throw out my current best suggestion that I'll call "Bobs_01" (subject to being superseded by Bobs_02, Bobs_03, ...):

The "this" might not be defined well enough. And how does the phrase rub with "fair use" of published material in discussions elsewhere? Text published become a store of study material where fair use of some quoting is accepted as not breaking copyright.

Spelling and punctuation sometimes can make a huge difference. Will minor punctuation be something that a moderator could change, perhaps with the (sic, ...) tool?

In my reading, I think the "this" is relatively clear. Since it's been used by phpBB for all this time, it's probably stood up to some degree of scrutiny. I may be missing something which might be aided with a phone call if you'd like. Please let me know ... or just call!!

I'm not quite sure I follow the "fair use" thought, but we would certainly allow fair use of our material and allow fair use inclusion of other's material. Deciding on the "bounds" of fair use is probably beyond the scope of these Terms of Service, and that would have to be handled on a case by case basis. The Terms of Service are basically forming the agreement that if the US Hawks does find a reason (copyright infringement, illegal threats, etc) that we can remove, move, or edit (with clear annotation) the post to make it compliant with the law or our own policies.

With regard to spelling and grammar corrections, I'm glad you (and others) have mentioned that. I've modified my original to include a "without requiring the poster's permission" to make it more clear that members can request spelling and grammar changes. But that opens another whole range of judgement as to when a change is covering mistakes versus intent. I think that will need to be covered by another more detailed description of how we decide on making changes. The Terms of Service could be amended to include or reference such a more elaborate policy, but since we don't have it now, it's a somewhat moot point. That's part of the bootstrapping process. We have to start with the simplest statements first and then add refinements along the way. I hope that is satisfying enough ... for now. ;)

Also, please feel free to write your own suggested proposal as well. That's the clearest way to express an alternate wording with no ambiguity.

Do you think this phrase to be an accidental obfuscation that may lead readers to believe that all posts here may not be considered, “fair use,” if readers should quote a post from the Hawks forum and use it elsewhere?

OK, it's time to start voting!!!

I'm going to cast my first vote as an example (not my actual vote) just to show everyone the format. As the motion described, we can vote multiple times, but only our last vote counts. So for this demonstration, I've arbitrarily ordered my choices with the most recent candidate first and the least recent candidate last:

  Bills_03 Bills_02 none_of_the_above Bills_01 Bobs_01  

In this example, I've also used "none_of_the_above" between Bills_02 and Bills_01. We should generally consider "none of the above" to be one of the choices in almost any election. If "none of the above" should win, then that means that we don't think we have the right choices yet, and we need to keep discussing the issue (the same as if there is no unique winner).

If anyone has any question on how to use the "vote" tag to get the votes to look that way (or any other questions about the voting process), please post a question or call me directly any time.

Here's my vote:

Here's my disclaimer:

I was initially considering not voting because I recognize that my position as founder of the US Hawks and current forum operator can be interpreted as carrying more weight than the other Board Members. I don't want that to be the case, and so I thought about not voting because I didn't want to steer things one way or another. I'm also very hesitant to express an opinion that goes against anyone on this Board because I value each of you very much and I really don't want to offend anyone by disagreeing with them publicly.

Having said that, I realized that such a "non-participation" policy would rob the US Hawks of any good opinions that I might actually have (no laughing please). It would also set a precedent that we have to be afraid of offending people. We will never succeed with that limitation. So I decided that I would vote, but I would vote later (as I have), and I would emphasize that I am just one member of this Board. So let me explicitly ask that my vote here not sway anyone beyond the value of my comments themselves. Thanks.

Here's my reasoning:

I primarily chose Bobs_01 because it was the shortest and I also felt it was the clearest. I voted "none_of_the_above" as second choice because I just didn't like the asterisk/footnote on "edit" because it created a "detour" from the main text which I felt distracted from the original Terms of Service. I like the idea of giving examples, but I would rather have such examples be given in our Standard Operating Procedures (SOPs) so we can relatively easily expand them and change them as time goes on. I don't think we should be changing our Terms of Service as often as we might need to change our SOPs.

I also didn't feel that the Fair Use or Spelling Corrections issues were appropriate for the Terms of Service. The Fair Use of anything on our site is already covered by existing law, and so I didn't feel the need to call it out in the TOS (although it might fit in our SOPs as a clarification). Similarly, I didn't feel the Spelling Correction issue belonged there because such corrections are "cooperative" in nature rather than "adversarial". Whether we like it or not, the Terms of Service - as a legal agreement - is somewhat adversarial. It's saying what we (the US Hawks) feel we need to be able to do to protect ourselves from a situation that goes awry. Imagine someone very disruptive on our forum with the resources to haul us into court for as long as they want (a situation that's become recently familiar to me). We want our TOS to protect us as clearly as possible. Opening a crack for "spelling corrections" opens a potential flood of issues ("I'm sorry, I misspelled 'nice guy' as 'jerk', could you correct it for me?"). Things work very well with reasonable people, and I don't think there have been any complaints from our reasonable members. But when people join with the intention to disrupt us (as I believe we've seen), then we're going to need to fall back on these Terms of Service to help us. They need to be both clear and in our favor.

I sincerely hope that my honest vote and criticism doesn't offend anyone to the point of quitting. If it does, then maybe that's telling me this would never have worked anyway. I sure hope for a better outcome!!!!

Thanks to everyone for participating, and a big thanks to Bill for pointing out the problem with leaving the word "edit" in the Terms of Service without any restrictions. You'll notice that every candidate that was submitted contained more restrictions on editing than the original Terms of Service, and that would NOT have happened without your input Bill. So whether your specific proposals win or lose, you're input wins in any case because it was incorporated into EVERY proposal. Thanks very much for being such a positive influence on whatever we decide.

As the last line states, there is no candidate that is preferred over all others when compared one on one. This is essentially a tie resulting from Bill and myself being the only voters, and both of us preferring our own proposals over the other.
