After rereading Bob’s reasoning for his vote I was persuaded that a ratification of the TOS as it stood would be a starting place from which we could work from with later modifications or amendments if deemed necessary.
At least the trial boards vote, advisory in nature, would show support of the TOS which is actually what everyone registering to get on the website clicked on as a condition of US Hawks membership.
In fact the TOS has already been agreed to by more than just two board members.

I had house guests Saturday through Monday and lost track of time. When I logged on to change my vote I discovered I was a day late. I was intending to change my vote to Bob’s 01.

That still would not have established a quorum and a show of support.

Bob made a motion for time limits on the discussion and voting but all Trial Board Members my not have seen the posting possibly until after the voting closed.
This brings up Scott’s point about having set times for Trial Board meetings.
Until such time that a reasonable time frame for the start and end of an issue is agreed upon by all Trial Board members we may continue to find a poor showing at voting time.
To get things moving I've decided to back off the knit-picking for now.

Whereas: we all clicked our approval of the Boiler Plate TOS to register, --
Whereas: we are again open for discussion, motions, and voting,----
Whereas: we can revisit the TOS for amendments or SOP,---
  I make a motion to approve the Boiler Plate TOS final paragraph as is.     Bills_A1  
(is there a second to my motion?)
Doing so may lead to you being immediately and permanently banned, with notification of your Internet Service Provider if deemed required by us. The IP address of all posts are recorded to aid in enforcing these conditions. You agree that “US Hawks Hang Gliding Association” have the right to remove, edit, move or close any topic at any time should we see fit. As a user you agree to any information you have entered to being stored in a database. While this information will not be disclosed to any third party without your consent, neither “US Hawks Hang Gliding Association” nor phpBB shall be held responsible for any hacking attempt that may lead to the data being compromised.

I vote   YES   as well.

But I also very much liked the idea of putting some constraints on the editing as you've mentioned Bill. If we ratify the current TOS, I'd like one of us to open a topic to address that issue.

I think this is just part of our "growing pains". The TOS is probably considered pretty boring to most folks, so it doesn't surprise me that we didn't have people sitting on the edges of their seats waiting to vote.

The big plus to having set times is that we could accomplish things pretty quickly. The downside is trying to find a common time for everyone.

But back to my original point, I think we're still too new to this on-line voting process to be able to make a judgement yet. Let's try a few more votes and see how it goes. I also don't mind calling people to let them know that a vote is pending if that would help. Just let me know. : )

Thanks Bill, Scott, and Sam. That's four out of 5 voting in favor of the motion with Joe not having voted yet. Joe is invited to add his vote any time in the near future.

That approves our Terms of Service as they stand. I'll be moving these two paragraph 3 topics to the public area shortly.

Thanks to all Trial Board members. I think we're starting to get a feel for how this might work, and we're also learning some lessons about how to conduct on-line meetings and voting. I'm very optimistic about our future. :D

I see that the TOS has been approved by the majority of the TBM.
Slow Joe. I am still wrestling with "will not be disclosed to any third party without your consent,"
My pause concerns whether such input in focus includes the text of posts or not. If the data in focus includes the text of posts, then the USHawks seems hog-tied by the "will not" clause.

Full text: "As a user you agree to any information you have entered to being stored in a database. While this information will not be disclosed to any third party without your consent,"
Text I enter in posts may be given to third parties at any time. Text from the forum has often been given to third parties. Does the TOS as such put USHAWKS up for liability for such sharing to third parties. That "any" information gives me pause. It is not clear to me that forum-message text is not included. Was the intent of the paragraph concerning just registration information? Not clear to me.   Late spirit vote: No.

We can revisit this issue with amendments to the motion voted on.
Can you suggest a phraseology that would answer your concern?
It is possible that your no vote will prove to be the strongest vote cast.
