Winning Public Access to Federal Airspace
Consider how the public has won access to the ocean and its adjacent beaches.
Consider how the ocean of air that is Federal airspace is open now for public navigation without having to join some tunnel-visioned private club or specialized corporation or having to put profit funds into some private company's coffer. Launch access is implied; where are the public access paths? Adequate reasonable access ways for the rich and the poor alike? Run and be flying? Quiet gliding?

What are the motives and means that have private parties effectively interrupting the public access to the public airspace? How might the government assure its people access to the federal airspace? What is already done to give access to the federal airspace? To sectors of the airspace? To local sectors of the airspace? Airports, launch pads, ...come in flavors and sizes. How much room does a HG need here or there? Alternative HG launch methods. Are there unfair rules working here or there? What might be unfair about some rule here or there? How best to gain access where the public wants access? How might the public express its concern when an unneeded unfair blockage of access occurs?

As there is public access to the ocean at Torrey Pines, historically there was some public access to the federal airspace sector over Torrey Pines cliffs. What is the history of the public access to the Torrey Pines federal airspace? What is the contemporary status of public access to the federal airspace over Torrey Pines cliffs, a national treasure? Are there some unfair blockages occurring regarding public access to the public federal airspace over the Torrey Pines cliffs? What are the alternative access means to the federal airspace over Torrey Pines cliffs for kites, gliders, model aircraft, powered aircraft, paper hand-tossed gliders, etc.? Comprehensive answers are sought. Common justice has one responsible for any injuries or damages that one causes; governments may carry the burden of some common wear and path formation and maintenance (roads, highways, paths, bridges, gates, ...). Governments may establish some user fees; but in total or summary: equitable access for rich or poor seems to be what is to be the final story.

Hang gliding people form just one type of user group; they need not be organized to use the federal airspace. Each citizen unorganized may use the federal airspace; the government does not require that a citizen gather all his or her steam to organize for the purposes of navigating in the federal airspace. What is required by F.A.A.: don't injure others or their properties in the air or on the ground from the air while one uses the federal airspace; such meta rule is expanded in F.A.R.

When a private entity has worked a way to stifle public access to public airspace, then what might be done about the losses that the public suffers? Loss of recreation, loss of navigation, loss of funds used in workarounds, loss of time in workarounds, ... ? :?:

Many of the USHPA proponents say that it's better to be "self-regulated" than for the FAA to step in.

But would the FAA ever have removed a pilot's license because he testified in court against a reckless paragliding school? Would the FAA ever have removed a pilot's license because he spoke out about unsafe practices to his local government? Would the FAA ever have removed a pilot's license for filming an instructor demonstrating unsafe practices?

The reality is that the FAA would never hold the kind of "kangaroo court" that USHPA has held. USHPA has demonstrated that they would rather silence people speaking out than correct actual problems. I hope the FAA understands that USHPA's "self-regulation" is actually self cover up.

"Self-regulation" can be just that: regulate oneself. Or by twos or threes or fours. Small smart club may regulate their hang gliding.
