Now, that seems to fit! At least the "daring" part! Deciding to face down a couple (Air Calififornia Adverture/David Jebb groupie) police officers who, unlike a number of their fellow officers, didn't actually understand the law - but instinctively (?) knew that if someone complaints somebody else must be arrested - seems to me to be a pretty clear act of daring.

However, Bob did take the time required to break down his glider to think about his actions, so, . . . perhaps what Bob undertook was more of an intellectual endeavor? Now, I think Bob is smart, but do I think he could imagine (however many) people typing away on their keyboards in support (or not) of his decision to not leave a public park where he'd been peacefully occupying a few square feet of space, after being assaulted? I do not. I think Bob was confused about why the police officers want to arrest HIM!

Now, if Bob had not allowed the police officers to arrest HIM (and instead had left the public park) he would never have been able to find out the legal (?) basis for the officers' actions. I think, rather than being some kind of "stunt", this is an example of Bob K's undying sense of curiosity!

As we sit here in front of our computer screens we are teleported, via the internet, into the world of Bob's curiosity. We ourselves are wondering WHY DID ALL THIS HAPPEN? To one degree or another we are staring ahead, with mouths agape, and thinking, "I can't believe this!!! Has this really happened in the US of A? . . . A person arrested because a few other people threatened him in a public park - because he was operating a video camera?"

I think that Bob, when he gets into Court, should ask the judge which number he is (out of the 1049 or so other people in San Diego who were also using a video camera or I phone that day). Clearly, since taking video in a public place is now a crime in San Diego, it would be nice to know where Bob stands in that long line of (accused) criminals, waiting to see the judge. Then again, it's probably "judges" considering the large number of (accused) law breakers needing to be deal with.

I wasn't a bit surprised at Rich Hass' response, though. Ignorance and arrogance usually seem to go together.
It would be interesting to have heard the conversation between Hass and the U$hpa lawyer after Rich's initial corporate response.

The ability of U$hpa officers to shoot their mouth off before consulting said lawyer and maybe the borg 'fixer' probably changed as well as the helmet rule.

Are you satisfied with that?

On the RGSA Hawks message board I see a post that Robin put up that looks a lot like a reference letter would look like. Copy/Paste that to your lawyer.

The rumor of my death was an exaggeration. People have been lying about me for a long time.
Birthday 63 with Sam Clemens, again.

Haven't written much lately. Wrote plenty in the past and where has that gotten me?

I still have hope that we all wake up but at times I have my doubts.
Eugenic toxins soil the brain and life is entertainment.

U$hpa corporation is an arrogant parasite on an entertainment.

Corporations have no soul and Rich Hass is tone deaf. He comes across as an arrogant prick.
He incorrectly chose the wrong side in this "incident/stunt".
The "stunt" is the embarrasment to the borg that needs to go global.
It's time to post the video. That's my legal opinion.

Win in the court of public opinion before you invest a whole lot in lawyers.
The cops gave themselves an out by refusing to see the video. There is no action there.

On the other hand, Gabe and Robin contemplated for 30 minutes the intent to commit a crime and then they did it.

Individual U$hpa members can petition for sanctions against other members. Gabe and Robin should be sanctioned by the corporation for their criminal behavior. The longer U$hpa condones that behavior, the worse its going to be for them. They should be overwhelmed by the bad publicity for the errors of their way. The best way to get the ball rolling is to publish the evidence of the crime.

As far as anyone who filed a false police report against about Bob, . . .

ARTICLE V

MEMBERSHIP

SECTION 1. QUALIFICATION

. . . The general qualifications, rights and privileges of each class of membership shall be as set forth in these
Bylaws . . .

(a) Contributing Membership: Any person of good character, and dedicated to the purposes of this corporation
shall be eligible for a Contributing Annual Membership . . .


By the above standard, people of bad character (especially those who commit crimes against fellow USHPA members) are not eligible to be members of the USHPA.

If the USHPA does not revoke these individuals' member and/or Instructor status, then the USHPA is based on a FRAUD. Accepting or retaining members with demonstrated BAD character - and doing nothing when they (literally) attack one or more members in good standing, . . . is in violation of the USHPA's published Corporate SOPs. Every member who pays the USHPA yearly dues - with the idea that the USHPA will follow it's SOPs, is being defrauded.

I also think that publishing the video to YouTube may be a good thing.

The USHPA (after being sent a link) would have the ability to KNOW the bad character of those behind Air California Adventure Inc. (i.e., current [but criminal] USHPA members and Instructors).

Time to lift the rock and shed some light in an otherwise dark place.

It's not over ... til it's over.    A long time friend gave me a gift engraved with a quote from Winston Churchill: "Never, never, never, never quit." (plus or minus one "quit" since this is from memory).

We founded the US Hawks back in 2010. It's taken 4 years to slowly get past Jack's "iron curtain" on hanggliding.org, and we're finally starting to get the growth we should have gotten back when the HGAA was started. That's OK. The time has helped us really figure out who our friends are.

Warren, you've still got your own club forum (Mo Hawks), and we've added a blog section. And if neither of those fit, there's always the "Free Speech Zone". What better place for "Free" than that? I hope we see more of your posts in the future!!!

Rich Hass has been choosing the wrong side at Torrey for as long as I've known him. But we actually owe him thanks because I don't think we'd have an alternative (the US Hawks) if it weren't for the arrogance that you've mentioned. Rich Hass could very easily have supported things like balanced representation on the Soaring Council or open voting by Directors, and those things would have made it harder to build support for an alternative. But Rich Hass has arrogantly thumbed his nose at these simple fundamental requests ... and here we are today ... gaining more and more new members and chapters every year. Thanks Rich!!!    :thumbup:

Well, there's a lot going on here. After that incident, Robin Marien had the audacity to file for a "Temporary Restraining Order" (TRO) against me. In California, those are given out with no questions asked of the other side (me). However, they did have to file sworn statements which are provably false. So I've hired a lawyer, and I'm sticking with his advice on what to publish or not. I have also shown it to a few selected people (like Jacmac - our club President) so he could make public statements confirming its existence. I assure you that it will all be published eventually.

I used to have a lot of faith in the "court of public opinion" until I watched Jack manipulate the "public" into kicking out myself, Scott, and many others. The HGAA was a modern-day re-enactment of the Salem Witch Trials. Human nature doesn't change a lot in a few hundred years. :(

Jacmac's statement doesn't carry as much weight as the raw video. This is not a complex legal issue and you either have a criminal case or you don't. The longer you hold your cards the less public support you are going to get. Some people say you don't have a legitimate complaint.

The only legitimate complaint is outside tandem fees. Bob was doing nothing about safety and just butting in on an instructor, pushing buttons. There is lots and lots of background that no one should ever go wading in. It is an easy place to go fly solo if that is your agenda or to go charging windmills. So it looks like thanks to Bob we have new rules coming from our national org regarding helmets. Did we need this, no.

If you don't try then you probably aren't going to win. Again, what is the lawyer's reason to hold back?
The power of the video will make or break your case. If you aren't confident it portrays what you say then wheels and deals behind the scenes from a snake in the grass officer of the court isn't going to do much but bleed you out.

You are a gnat against a corrupt system that lawyers feed on. Others are writing things against you that carries the same weight as your allegations. Bill Floyd will fly your glider but screw you in support because he is influenced by other arguments in the court of public opinion.

Wait too long and people will lose interest as the lawyer runs the bill up.

Here is the letter of reference I sent for Bob K's. lawyer to use at the Dec. hearing about "ROP."
To Whom It May Concern:

This letter is being written as a character reference for a fellow hang glider pilot, Mr. Bob Kuczewski.
I am 36-year veteran hang glider pilot. I know the history of the sport I love, as well as what is currently happening in that sport.

Mr. Kuczewski has been working tirelessly to keep things fair for all members belonging to the United States Hang Gliding/Paragliding Association. (USHPA)

Some people within the USHPA, The Torrey Pines Glider Port, and the City of San Diego, do not appreciate Mr. Kuczewski’s attempts to “level the playing field.”

Over the past few years, I've had opportunities to observe Mr. Kuczewski at flying sites, meetings, dinners, and as a guest in my home. During all of those occasions, Mr. Kuczewski never displayed any negative behavior that would even approach rising to the level of a restraining order petition against him.

I try to start with the assumption that everyone is a friend and let them show me otherwise. If you're ever at Torrey when I'm there, I hope you'll consider flying my glider.      :thumbup:
