Oh, and another thing, . . .

The City's definition of what aircraft are allowed to fly at the site are defined as such:

(a) Definitions.
“Full scale glider soaring” means flight by any motorless, heavier–than–air
aircraft now known or hereafter invented, used or designed for navigation of
or flight in the air in which the pilot, crew and passengers are carried
internally within the frame of such aircraft
.

“Hang gliding” means flight by any motorless, heavier–than– air contrivance
now known or hereafter invented, used or designed for navigation of or flight
in the air in which the pilot, crew and passengers are carried externally to the
frame of such contrivance
.

. . . .
[emph. add.]

Except for RC model gliders there are no other aircraft listed as being allowed to fly at the site. Any other aircraft that fail to meet the above definitions, yet are allowed to fly at the site, would be in violation of the City permit/lease.

Frame, . . . hang gliders and sailplanes have frames. Those frames can and do act so as to keep people from being hurt and even killed. Is there a frame hidden within an inflated canopy of which I am unaware?

I'd like to show up at Torrey Pines with a bundled up hang glider sail and ask Robin Marien if I could fly it there. I'll bet he would say "No!". I wonder why? You mean I need a frame for it to work properly ? ! ! !

Time for change.

I got the impression that BobK has been framed so maybe it would work for you, too.

But as I look at the lease it defines the "lessee" as Air California Adventure LLC - As owned by David Jebb. Now the California Secretary of State has defined this particular LLC as currently in suspended status. Meaning it can't do business within the State of California. Hmmmmm. Odd. There are no records of the lease ever being updated. Or any record of the concession ever being put (back) up for public bid. :eh:

As well, since a "Limited Liability Company" (owned by Jebb) is not the same as an "Incorporation" (majority owned by Marien) then the lease of record with the City is legally invalid - On Its Face. The business entity now operating at the site is NOT the same company. Not an LLC and not owned by David Jebb (the signer of the lease).

I particularly like the following:

San Diego Municipal Code Chapter 6: Public Works and Property,

Article 3: Public Parks, Playgrounds, Beaches, Tidelands and other Property

Division 2: Soaring or Gliding Activity

§63.0201 Soaring or Gliding Regulated

. . . .

(b) Any person who on any park, beach or other property owned or maintained
by The City of San Diego conducts or participates in any soaring or gliding
activity, including full scale gliding, hang gliding, and operation of radio–
controlled model gliders, . . . without first obtaining a permit from the City, or
whose permit has been revoked or suspended is guilty of a misdemeanor

It sure sounds to me like Bob was attacked by very true criminals. Those criminals have somehow decided, in violation of what are usually called "Municipal Codes" (often described as local laws) to operate a business on City property with no valid lease or "permit". That makes them criminals and the Assault and Battery they committed against Bob fits perfectly with those type of characters.

Wait now! didn't someone on a Hawks thread somewhere indicate that the LLC was let run out by Robin M. (and so it was suspended by the AG) and that it was now something else and not a LLC? Who can help with that question? Was that Jacmac that posted that?

Bill,

Someone may have posted that info, I don't know. However, all that "letting a LLC run out" means (as far as I know) is failing to file a yearly company status report with the CA Sec of State's Business Registration(?) office.

At this point in time, (I've looked up this info on the CA S.O.S. Web page) I know for a certainty that Air California Adventure Inc. is "Active" and also lists Robin Marien as the "agent for service of process" (this is from memory as to exact wording). Robin Marien has also asserted that he is the majority share holder of ACA Inc.

I posted some of this info to the Oz Report Forum - in the "Bob's Video Log" thread - but that was only last week some time. Not sure if what you're refering to was longer ago than that.

The importance of this information is that the current incarnation of Air California Adventure - is NOT the same company (or owner/flight Director) as listed in the lease with the City of San Diego. The "Incorporated" version(?) has no legal standing - or lease - with the City.

And what's even better than that, . . . (wait for it) . . . is that Robin Marien referred exactly to the invalid lease in his recent statement of claims regarding his request for a restraining order against Bob K.

Since that document has already been submitted to the court it is part of the legal record. As such, it is evidence that Robin Marien (and Inc.) are essentially illegal squatters in a City of San Diego Park. Looking back a few posts you may note that, as such, these individuals are guilty of a number of criminal offenses.

Recall this section:

(b) Any person who on any park, beach or other property owned or
maintained by The City of San Diego conducts or participates in any soaring
or gliding activity, . . . in willful or wanton disregard for the safety of
persons
or property, . . .

Please note the part about "willful or wanton disregard for safety". All Bob was doing the other day was documenting ACA Inc. personnel (squatters) disregarding their own safety - and the potential safety of their students - by failing to wear appropriate safety gear during PG training demonstrations. They were also using soaring apparatus that fail to meet the City's definition of allowable soaring aircraft - in that they do not include structural (safety increasing!) "frames".

. . .or without first obtaining a permit from the City, or whose permit has
been revoked or suspended is guilty of a misdemeanor

For all intents and purposes ACA LLC's lease/permit has been revoked/suspended as per actions taken by California's Secretary of State. The squatters otherwise occupying the space are doing so in criminal violation of City Ordinances.

How do criminals get away with calling an innocent citizen a (potential) criminal - for whom they require a restraining order against - because he was documenting them committing criminal acts?

Is this whole mess utterly absurd or am I missing something? :?: :?: :?:

Looks like you have a good grasp of the situation but it just occurred to me that I have my players mixed up. Was Robin M. in law enforcement?

A little bird told me that he was employed as a bouncer sometime in the past. I don't think that counts. But then, I don't know everything. However, a bouncer is a wannabe security "official" and David Jebb was an "official" under cover narcotics officer. Could there be a link?

I've heard that cops are just (cowardly) criminals with a badge. I wonder what bouncers amount to? Wannabe criminals without a badge?

Bill,

Jebb Sr. is the retired San Diego police officer that was/is in control at Torrey. Not sure, I don't think Robin M. was ever in police work.

Can you believe, ? When I flew there '77 -'84 the retired police officer in charge was Bill Armstrong. Bill was a HG instructor, back then. Most of his instruction was done at Little Black, ~5mi inland as I recall.

At some time he became a PG instructor, when PG instruction was permitted at Torrey and P1 could fly there. Armstrong is the only individual that ever stood in front of me preventing launch at Torrey. Last I heard he is still there and doing the PG instruction.

The info I got from the local Torrey HG pilots, back then, was that there was city corruption involving the retired :? police.

This corruption is nothing new. Like I told insider Torrey tandem pilot Bille Floyd, "even if in days gone by".
