The
"how what he did could be twisted to be perceived as wrong" part of your post is the actual
HEART of the matter.
The "system" involving Air California Adventure Inc. (Robin Marien, Gabriel Jebb, his pop, etc.) has been perverted - obviously another word for twisted.
I've spoken with parties closely connected with this issue and brought up what is called "Black Letter Law". Black Letter Law includes laws that are so old and so well proven to be just (as in
justice) that they can not be refuted. One of those Black Letter Laws involves the concept of the "Pubic Trust".
Long ago in England certain waterways were being obstructed by private individuals (and businesses?) who claimed that they could prevent shipping from moving through "their" section of waterway. This private ownership of waterways was found to be improper and therefore illegal. It was determined that the "Public" owned the waterways and ANYONE could make free use of them for transportation and other typical purposes. The government would insure this right as a "Trust". In this way the legal concept of the "Public Trust" was created. The government ensured the Public Trust in regard to the use and navigation of (in more modern times) public spaces.
Now, the air space above Torrey Pines is navigable by aircraft who's operators are otherwise qualified. Access to that air space is by way of a City of San Diego
PUBLIC Park. Not only is the
PUBLIC Park a public space, but the Air Space above the Park is unrestricted public (usually?) airspace. The legal concept of the government acting to ensure the Public Trust can not be separated from the aviation related activities that take place at (and above?) the City of San Diego's Torrey Pines City Park.
Unfortunately, there has been a perversion (twisting) of very basic justice going on at Torrey Pines City Park for a long time now. This condition relies on the
ignorance of your average aviation involved citizen. The City of San Diego has "Sold"
access to the airway and (for all intents and purposes the) the airway itself, via a
PUBLIC Park - to a private business. In doing so, the City of San Diego has acted in violation of the fundamental legal concept known as the "Public Trust".
Everyone in earlier posts that doesn't understand what Bob K did that was wrong are thinking in (long established) terms connected with the traditional idea of the free use of public spaces. However, what everyone must recognize is that Air California Adventure Inc (with the City of San Diego
blindly looking the other way) has established their
OWN rules. Air California Adventure Inc. has done so, essentially, to aid in the maximization of their profits.
What makes what Bob K did wrong, comes about because what Bob K did was in violation of (not of any law on the books, but rather) the Corrupt, Perverted, Twisted Rules allowed to be in put in place by Air California Adventure Inc. (Robin Marien, Gabriel Jebb and others). Those Corrupt, Perverted, Twisted Rules have been given support (muscle) by certain (corrupt, or just plain stupid) City of San Diego Police Officers.
As I have said before, it's time to stop playing by the concessionaire's rules - or the corrupt police's rules - or the corrupt City of San Diego's (failure of enforcement) rules.
It's time to go into Federal Court and file a "Violation of the Public Trust" complaint. Ask for $10 Mill in damages. Get ten or more people to file the SAME complaint in their own name. Heck, I'd be willing to organize a lot of what's needed but I'm on the wrong side of the continent.
