What happens when you try and change the status quo? I'm thinking this is a good example...

Recall that BobK was first ever to fly in one day at Torrey Pines, San Diego all four aircraft: Model RC aircraft, sailplane, soaring parachute (sometimes called these days: paraglider), and airframed hang glider. (Was he the only pilot ever to do such honoring of the site? [ ] )

According to John Heiney's article, given the relative rarity of sailplane flights there and the relative newness of paragliding, it's likely that I may have been the only person to do so.

The Board voted to initiate the procedure for expulsion of Robert Kuczewski under Article V, Section 4 (a)(iv) of the Bylaws:

Expulsion of the member based on the good faith determination by the Board of Directors or a committee designated to make such determination that the member has failed in a material and serious degree to observe the rules of conduct governing this corporation as promulgated by the Board from time to time or has engaged in conduct materially and seriously prejudicial to the purposes and interests of the corporation.

What is the name of the board member that made the motion for expulsion of Bob K.?

What is the name of the board member that spoke the second to the motion?

What are the names of all board members in attendance and which way did each vote?

Do the people voting on the expulsion derive any source of income from the sport of hang gliding or paragliding?

Will the same people making the charges also be sitting in judgment of the evidence presented?

Bob K.,
Now that your potential expulsion has been snatched from the purview, in the short term, of the court and is in the hands of the court of public opinion your assault video on Youtube is your better move.

Quickly, so that members that know you have fair treatment of all members as your goal will have time to send the link to their contacts.

One small correction. My expulsion isn't in the hands of public opinion. It's in the hands of a USHPA Board of Directors that's desperate to get rid of me - at any costs. Mark Forbes won't say how much Tim Herr's time has cost all of us over the years, but you can bet he's well paid - by us.

I would gladly put my fate in the hands of public opinion in a fair setting where I could debate the facts. But that's not what USHPA is structuring. It will be a kangaroo court like the Austin Texas 2009 ambush / witch trial.

Furthermore, there are no standards of evidence or standards of proof at a USHPA witch hunt. They can come to the conclusion that I shot JFK if they want. Whatever they vote for stands as if it were true - whether it is or not.

Bob K.
If you wish to preserve your right to a civil/criminal remedy as a victim of assault then you will need to file a complaint against the perpetrator soon. There is a statutory deadline. Now I understand that you actually did try to file and were impeded, had to return with a lawyer. Were you successful? Did you demand an arrest as a victim ?
So far the person that allegedly assaulted you is presumed innocent. Therefore you have not been wronged by an assault.
You have been attacked from two sides possibly three if the lawyer is working outside on his own agenda for the sake of leverage.
You are only defending against a kerfuffle so far and fending off a mad dog with a feather duster.
In Vietnam and Cambodia when we were AMBUSHED our training was to, never retreat, never defend, but always attack.
If you try to retreat you will run into their preplanned finally. If you defend they have you right where they wanted you and have you. If you do not attack you can forget about hearing them cry, "chu hoi". (You win. Take me into your open arms.)
This U$hPA expulsion action is too far over the top.

Spelling proposal: Now a lowercase "u" as united it is not. And now a lowercase "a" as the association is disassociating part of the heart of HG in itself:
thus
u$hPa

And soon, the $ will be challenged as a swarm of pilots decide to form a HG-focused world for their sport; a stopping of buying the flow from u$hPa
while funding a new HG-focused national org will challenge the $ amount; for some while later, the P will still grow its capital, but HG community won't be funders. Biwinguals will gradually succumb to the effects of the negative-G zonal matter unfortunately; at some point families of dead PG pilots will form class action suits against someone or a group on a basis of gross negligence with respect to the sure-to-effect injury by using the collapsible high-aspect ratio canopy in the PGDMC; PG instructors, schools, manufacturers, sellers, etc. might be grouped as defendants. Jailing for taking pictures is a tiny part of reaction that one might see as the PG world gets weighed down by the result of its gross negligence in doing what it could to save lives and losses; it could just stop being with activity in the PGDMC; just launch from powered aircraft or balloons at high AGL far above the PGDMC; cut away the PG and enter PGDMC with a low-aspect ratio high-wing-loaded parachute. HG should separate in swarm from u$hPa to help HG be itself and in so doing help the public know the facts of the PGDMC matter with respect to the high-aspect ratio parachutes (sport PGs).

Prediction: There will be a special club of photographers dedicated to capturing the incidents within the PGDMC. The PGDMC Photographers Club will supply images to families losing loved ones. The photographs will play a part in the lawsuits against agents that hid the full and certain play of PGDMC within PG activity. HG will do well to fully disassociate from the PGDMC-using PG world. Inasmuch as HG supports such PGDMC-using PG world, then HG will rightly suffer the costly results of such support. HG, withdraw in swarm from such support of the ongoing linearly-sure disaster! Getting jailed for taking pictures only hints at the costs coming from associating and supporting the PGDMC-using PG world.
Those working in the PGDMC-using scene would do well to find another way to earn a living; someday the affected public might come to see the scene for what it is. What are lives worth?
