Legally Fly at Torrance Beach?

Ok guys, if you have not stirred things up enough, I think there is a legal loop hole to fly at Torrance Beach again.

But the city would not be happy.

This is the wording of the Torrance Municipal Code: 45.6.24 OPERATION OF HANG GLIDERS.

a) It shall be unlawful for any person to take-off or land any hang glider in the City of Torrance.

b) For the purpose of this Section, the term hang glider shall mean and include any hang glider, glider kite, kite, or other motorless vehicle, device, or contrivance which enables a person to fly, glide, soar or otherwise be propelled through or sustained in the air by human power or air currents; provided, however, that the term hang glider shall not include any aircraft regulated or required to be registered by the Federal Aviation Administration of the United States or the aeronautics authorities of the State of California.

The point is the Federal Aviation Administration regulates Hang Gliders under FAR Part 103 so a Hang Glider regulated under Part 103 should be exempt from the Torrance Municipal Code "the term hang glider".

Now the catch is the airspace at Torrance Beach is within the Class D airspace of Zamperini Tower (Torrance Airport) so if permission could be granted by the Zamperini Tower to operate within the Class D airspace at Torrance Beach and there is compliance with Part 103 in the avoidance (not creating a hazard) of people and property, a pilot would legally be within the law to fly again at Torrance Beach.

My bet is the police would be called and a citation would be issued by the city.

Just thinking about the law.

We will be guests of the hang gliding school (Joe Greblo's) that operates there regularly, with a permit.

Google Earth shows hang gliding there.
