This Blog is intended to document various aspects of the law as I have personally discovered them in my ongoing legal journey. While this blog won't be strictly limited to hang gliding, it does arise from my ongoing effort to bring fairness and oversight to the Torrey Pines Gliderport.

Some of these posts will document specific items I've bumped into during my particular legal journey, and others might be more general pointers on where to find information itself. I will try not to be too specific about my case, but there may be times where it provides the best example.

I would like this Blog to remain relatively focussed on aspects of the law that others might find useful or at least interesting. Please keep in mind that I am learning as I go, so any given post should be considered a work in progress. Nothing in this Blog (or on this entire forum) should be taken as legal advice to anyone.

Others are invited to participate, but please keep posts about legal principles. You are welcome to use examples, but please don't let the examples become the topic. I will ask the moderator (me) to move any posts that stray too far afield.

FRCP - Federal Rules of Civil Procedure

This first post (and this entire topic) was sparked by my recent discovery of the "FRCP" (Federal Rules of Civil Procedure). I had been struggling through several self-help legal books, and they kept mentioning the "FRCP". Here's the link that I eventually found:

Natural law :: "Natural law (Latin: ius naturale, lex naturalis) is law that is held to exist independently of the positive law of a given political order"

Political orders may or may not embed natural law. May or may not align with natural law. When positive law contradicts natural law, be ready for natural injustice.

Clarifying my use of the phrase "positive law" in former post:
"positive law" does not mean good or bad law here; "positive" here regards something different than the good or bad spectrum, but of that which is posted (placed, deposited, positioned) by human decreeing.
"Positive law" https://en.wikipedia.org/wiki/Positive_law "Positive laws (Latin: ius positum) are human-made laws that oblige or specify an action."
Such positive law does not automatically imply that such law brings justice or good, though often humans make laws and rules with good intentions, but also sometimes with bad or selfish or even unjust intentions. Of course, positive laws may sometimes be ill conceived or worn out or missing the mark of prior purposes or found to be no longer useful. That is, some positive laws may be negative; and some positive laws may be good (that sense of positive that is in the good-bad spectrum). Thus, not all positive laws are positive (now in the sense of good in the good-bad spectrum).

The body of political law made by humans is positive law (simply meaning human-made) even when some laws in the set of laws may be negative in the sense regarding the good-bad spectrum.

The posted or placed or deposited or posited or "positive" rules of the HG site may contain some negative matter and maybe ill oppression or even mal-conceived pressuress, etc. Yet such rules are still posted or placed and thus are probably human-made and thus are "positive law."

David Jeb, won the lease (under false pretense*) posing as OUR leader, representing the hang gliding and Paragliding community as a whole.

(Using his color of authority*)  was it federal or state to gain control over a existing, establish Credible Organization.

Doesn't the (public have a right to know*), how much of our money $$$,... has gone for what, where and to whom,... (FOR WHAT CAUSE*)

The current leaseholder is using an established protected historical site TPGP as a platform to commercialize free air space (exploiting the public for personal gain and profit*) with intent.

By his own decree, the Collection of money to use a free public park is (EXTORTION*) knowingly or not (The City hold final liablties*), for allowing the exploration of our freedoms, the threat of safety, injury and personal loss of the public,
 
This is (miss appropriation of public funding*) and (diversion of public fun's in to his privat accounts*). 

With Zero Democracy, The act of steeling Our freedom, then selling it back to me as a pass, is a (direct violation of my civil and public rights*).
 
With no regard to common Law,...  responsible for (blocking the public's Free Use & the path to free airspace*)
 
Gliderport training has (endangered the public's safety*) both in the Air and on the ground. including violation of lease (drug free workplace and employee's*)

Leaseholder has and is willing to (falsify reports leading to false arrest*) Lying to the public and authorities. (baring false witness*) with (malicious intent*) to include, tampering of equipment and failure to disclosing dangers.

Willing to bully (the threat of violence and or personal loss*) is well known, (Laying and waiting*) hiding behind children and the register. 

Openly (provoking fights in public park*) Militant gang like to divide and control over the public.

Controling Public's freedom of speech by threat

Cornering of the market is (racketeering*) then bringing the market to bare for profit $$$.

Formation of (Organized Crime, networking in Cohesion*) with others. including, (discrimination*) of those whom speak out.

Extortion* is said to be the easiest crime to prove,...  the act of (collection of public money*),...

(forcing the public to buy insurance*) & (sign unfair wavier*) not required by common Law.

Its Really (Violation and distortion of the original lease agreement intended use*)... operating as a Club.  Are you kidding Mandatory fee's, to use our free park and tolerate an out of control school & dictator...

THE FAULKCONER ~ BARBRA BRY PUBLIC SCANDAL could be considered (Breach of public office oath*) Procrastination (Failing to resolve Crime within a timely fashion*) is a crime

Forcing the public to agree and pay is "PUBLIC EXTORTION BY CITY COUNCIL CONTRACT" probable the worst case in recent history that I could find..

(Negligent Operator's*) operating in the Public sector, including (murder and wrongful negligent death law suits*) of a few pilots

Communications from the public can provide valuable information to the Grand Jury. If a matter drawn to its attention is within the legally permissible scope of its investigative powers and would warrant further inquiry, the Civil Grand Jury may request additional information. If a matter does not fall within the Civil Grand Jury's investigative authority, or the panel determines not to investigate a complaint further, no action will be taken.

The Grand Jury has no jurisdiction or authority to investigate Federal or State agencies or the Court. The jurisdiction of the Grand Jury is limited by statute and includes the following:

Inquiry into all public offenses committed or triable within the County and presenting them to the Court by indictment.
Consideration of evidence of misconduct against private and public officials to determine whether to present formal accusations requesting their removal .
The investigation and report on the operations, accounts, and records of the officers, departments, or functions of the County including those of any special legislative district or other district in the County, and the books and records of any incorporated city or joint powers agency.

The findings of any investigation conducted , because of a written complaint, by the Grand Jury can be communicated only in a report issued either at the conclusion of its study or in its formal final report, normally published at the conclusion of the panel's term (June 30th) and presented to the Presiding Judge of the Superior Court.

In order to file a complaint, you will need to complete and submit a

A list of possible SLAPP "experts" in S.D. Is the place to start, after a series of documents , and "documents handlers", by the "defendants" , is written. And a custody of evidence folder started.
The plaintiff will have 10 "files" on you, but you could have, "27. 8x10 color glossy photographs with picture and arrows pointing,..and on The back a paragraph ex.. plaining what it was all about."

Another folder is court cases which are similar to this case .




The "powers to be" will close ranks and use loopholes, continuance , SPAPP/ANT-SLAPP, and of course "a shell game" , to avoid accountability .

wizeGEEK and lots of homework will tell you/"US" finally , where the "pill" is.

Colored pills are easy to find. Especially when they go on camera and flip people off.

Once again, Maybe it's a personal problem
David Jebb Murdered his instructor to get him out of the way. Lie'd about the death,
The following day,  DAVID JEBB Assaulted me for what I said on national TV, obstructing court justice, using his color of authority,...  with his influence at SDPD Northern division to cover the death.

He told me his plans to exploit our freedom in order to commercialize the airspace. 
Because I wouldn't Lie about it, I was Out...    

JEBB Then, tried to take me out by mistake.,,, attempted Murder,... after being sued for 50k

So when Craig, does a Retired Cop-killer... that run's a current multi million dollar racketeering operation within the city have any Legal Rights

Jebb should be in special prison with his constituent's, planning his legal defense
~ He is a danger and a threat to society and or freedom
