2005 Opinion of City Attorney Aguirre regarding open government:

"Disclosure Of Officials’ Calendars And Official Writings Under The California Public Records Act"

City Attorney Michael Aguirre wrote:
CONCLUSION

In adopting two changes to the State Constitution and San Diego City Charter, voters have decided to significantly expand their access to documents in the possession, custody, or control of their public officials. Access to such records is critical in order for the public to carry out their deliberative and accountable democracy rights.

The news media have chosen to test these new provisions of law by requesting calendar, emails and phone records of certain San Diego elected officials. Although the public may have had a right of access to these records under prior law, they now clearly do under the new Constitutional and Charter provisions adopted by the voters.

Respectfully submitted,

MICHAEL J. AGUIRRE
City Attorney

Well said Michael!!!

Hello Bob,

What is the cost to taxpayers when you have a lack of leadership and executive experience at City Hall?

Take the City’s purchase of the old Sempra Energy building on Ash Street, approved right before I joined the council. Cost to taxpayers:

  • Purchased at a price of more than $127 million over 20 years
  • $20 million+ in cost overruns for tenant improvements
  • $18,000 in lease-to-own rent paid EVERY DAY since 2016 while the building is vacant!
  • And potentially MILLIONS of dollars defending lawsuits

Who the heck was doing the due-diligence on this deal?

We need to know how much this mess is going to cost to clean up.

Todd Gloria made the motion to purchase and Scott Sherman seconded it, putting this massive liability onto the taxpayers. Now THEY want to run the City???

That’s why I’m calling for an independent audit on Ash Street now! Now they’ll do what too many politicians do: Walk away from bad decisions and ignore the consequences.

As Mayor, I’ll stand up for taxpayers. I’ll expose the political insiders who waste our hard-earned money that would be better spent dealing with big problems like street repair, public safety and homelessness.

And that’s why I’m the ONLY candidate with the independence and experience to clean up this mess at City Hall and protect our neighborhoods.

Finally, if you saw the poll that came out the other day -- great news:

In the mayor’s race, a positive sign for Bry is her strong favorability rating among voters familiar with her. Such voters view Bry favorably at a rate of 3-to-1, while Gloria’s rate is just over 2-to-1 and Sherman’s is less than 2-to-1.

It’s clear: when voters know about me, they vote for me. That means, if we get our message out, we win.

Here’s the problem: Todd Gloria and Scott Sherman have two powerful political parties that can spend an unlimited amount of money on “member communications” to voters.

Here’s the reality: Scott Sherman has ZERO chance to beat Todd Gloria in November. A vote for Scott Sherman is, simply, a vote for Todd Gloria.

Here’s my question for you: Can you contribute today so we can get the message out?

We have a POWERFUL television commercial almost ready to launch.

We have hundreds of volunteers.

We are defining the issues in this race.

But without YOUR support, San Diegans will have to choose between two sides of the same-old political establishment in November.

 Can you contribute?

Please contribute $5, $25, $250, or even $1,150 today and think about, if I’m your Mayor, just how much of your tax dollars I can save you tomorrow.

Clean up the mess!

Barbara Bry
Candidate for Mayor of San Diego

Election season is the only time we get a chance to hold politicians accountable for their actions.

Tonight, Bryan and I used trusty "Little Hawk" as a prop to call attention to the ongoing problems at Torrey Pines Gliderport.

We spoke to a number of Mayoral candidates ... including one of my favorites: Tasha Williamson:

Another favorite of mine is Rich Riel. Unfortunately, I didn't get a picture of Rich with Little Hawk. I'll put that on my "to do" list for future events.

I also spoke with the disgusting Todd Gloria. I have the whole exchange on video, but until I can post the video, here's the full text of what was said:

Bob: So Todd, what are you going to do about the deaths and abuses at the Gliderport? What are you going to do as Mayor?

Todd: I don't have a plan to offer you right now Bob.

Attachment:

Bob: When will you have a plan to offer us about the Gliderport? The deaths? The abuses? The lease that expired during your term? When are you going to tell us what you're going to do about It? Will you tell us tonight?

Todd: I don't have a plan to offer tonight. No Bob I don't.

Bob: When will you have one?

Todd: I don't have an answer for you right now Bob.

Bob: OK. Thank you. Good luck in the debate.

Remember that Todd Gloria is well aware of the issue (that's how he knew my name without me saying it). Todd Gloria was City Councilman during years of abuses and accidents. He was Council President during years of abuses and accidents. And he was Mayor for the better part of a year during accidents and abuses. In all that time, and in all those positions, Todd Gloria did nothing.

Now Todd is running for Mayor and he admits that he has no plan and no answers. Gee, neither Rich Riel nor Tasha Williamson have ever been a Councilmember or Council President or Interim Mayor, and they both have plans. How come Todd Gloria has no plan?

Eventually we all ended up in the "standing room only" La Jolla Community Center with 6 candidates (left to right):

  • Tasha Williamson
  • Scott Sherman
  • Rich Riel
  • Todd Gloria
  • Barbara Bry
  • Gita Applebaum Singh

Here are my written questions that I ended up asking verbally at the microphone. I had intended my questions for the whole panel, but for some reason the moderator only allowed Barbara Bry to answer:

Quote:
As Mayor, what will you PROMISE to do about ongoing:

  • Bullying
  • Accidents and Deaths
  • Retaliation for Testimony

at the Torrey Pines Gliderport?

And why should we believe you?

Bry dodged the question and referred me to "Real Estate Assets".

The big spender of the evening was Councilmember Scott Sherman with this gaudy rolling advertisement that he left parked outside all evening:

It turned out to be a super evening with lots of new contacts. I am very grateful Bryan was there to help with Little Hawk and to be my "wingman" in many conversations. Thanks Bryan. :salute:

Thanks for posting that video Margie!!

I also attended the Tuesday evening event sponsored by LAPA. I submitted a written question, but the moderator's didn't ask it. Here's a video frame of Tasha Williamson giving a great speech:

Tasha Williamson wrote:
Everyone up here has been a part of the problem. Everyone has made decisions without doing research. Everyone has cost this city millions of dollars.

All these politicians, all of them. Whether you are City Council or Assembly, our education is poor as dirt. And we have an Assembly member who's over it but has pushed nothing forth. We have City Council members who time and time again have told us that nothing's been rushed.

You represent us, and you haven't represented us. So I am running because I want to make sure that I give it back to the people that I have at the table - that we are the decision makers together. We are in this together. We are suffering together. And it is time to change together.

Make your vote count. Let them hear your voice in your vote. It is time for change. A corruption free city, a green city. Ending homelessness, making sure that we allow the people to have real transparency, and we are honest and up front with our failures and our successes. That we can all thrive and it's not an "us against them", it is all of us.
  :
How dare them? How dare them sit here and lie to you as if it's not a reality? You know it. You live it. You see it. You drive on the roads that are broken that have just been repaired that cost us more money. You hear the lies about a water department that they couldn't fix. But they gave someone 60 million dollars with a no bid no contract. Don't believe these lies.

Tasha always speaks from the heart.

After the event I followed up with Barbara Bry about her earlier advice to meet with Real Estate Assets about the Gliderport problems. I asked what she would do if Real Estate Assets refused to meet. Barbara's response was essentially that we'd cross that bridge when we got to it.

So far, I've called Real Estate Assets Division on Tuesday the 18th (once) and Wednesday the 19th (twice). I left messages requesting a meeting in all cases, and in all cases I mentioned that Barbara Bry had made the suggestion to meet. So far no meeting opportunities have been offered.
