If we went the insurance route wouldn't it be a better idea to not waive our individual rights, but retain a law firm to protect our rights?

I could be convinced that retaining a law firm would be the best choice. I have had this discussion with an HG instructor in NY and he states cases where state law that is designed to protect land owners failed in court. Example :: Farmer is tired of having snowmobiles pass his property-----he decide to put up signs and fences---snowmobile hits fence--operator is injured and wins a lawsuit Our legal system seems insane some days----where did good ole logic go ??

It will be hard to convince everyone that this is the way to go but I think you are right. In the mean time however that approach may be limited--No ? So many sites have been insured by USHPA and now the land owners expect it. It's a hard sell to convince them that it's ok and that they are protected without it.

PS--maybe I'll move to New Mexico

While I think we should be making better use of Recreational Use Statutes, this kind of specialty insurance may be needed in some cases.

It may depend on the situation. With public land, we should be using recreational use statutes. With private landowners, a waiver might help as well (in addition to recreational use statutes). In some cases, we might need to get insurance. In all cases, it's good to get legal advice.

Bob... XInsurance will cover liability for individual HG pilots. I applied and was given a quote. The quote was high but they sent a follow up e-mail that seemed to me was saying that the quote was negotiable . I did not follow up because I am still an USHPA member. Next year I may go that route if I end my membership. There may be a case to be made for better rates for groups of pilots or sites that absolutely require liability. I don't know !!

I totally respect Bill's point of view though and agree with him in every case possible.

Be sure to tell him what individual USHPA members are paying.
If they can beat the USHPA rate -- or even come close -- there may be some funny business going on.
